Conditional Release, Hendra Kurniawan Must Report and Must Have Permission to Leave Town

Head of the South Jakarta Correctional Center (Bapas), Unggul Widiyo Saputro stated that even though he is breathing free air, Hendra Kurniawan is still tied to Bapas Class I.

“Hendra Kurniawan has served his sentence at Salemba Class IIA Penitentiary. Starting July 2, 2024, Hendra Kurniawan will undergo conditional release as a correctional client under the guidance and supervision of the South Jakarta Bapas,” said Unggul in a written statement quoted on Wednesday (7/8/2024).

“This means that until his criminal sentence ends on September 6, 2025 and he undergoes 1 year of probation until July 8, 2026, Hendra Kurniawan is not completely free. He is still bound by the rules at the South Jakarta Bapas, such as the obligation to report himself once a month,” he continued.

Unggul explained that the self-reporting mechanism at the South Jakarta Bapas can currently be done face-to-face by visiting the Bapas office directly. Hendra Kurniawan will receive direct guidance and supervision from the Community Guidance (PK) of the South Jakarta Bapas.

In general, based on Article 56 of Law Number 22 of 2022 concerning Corrections, the Implementation of Community Guidance at Bapas which includes assistance, guidance, and supervision will be carried out through three stages, namely client acceptance, program provision, and termination.

Guidance aims to provide provisions in improving mental and spiritual quality, intellectual, skills, and independence for Clients. In addition, supervision aims to ensure the implementation of the established requirements and programs.

“In addition to being required to report once a month to Bapas Jakarta, Hendra is also not allowed to leave the city or go abroad without permission. If he wants to travel out of town, he must get written permission from the Head of Bapas South Jakarta. If he wants to travel abroad, he must get permission from the Minister of Law and Human Rights of the Republic of Indonesia,” he concluded.
