The number of inheritance division disputes between heirs that were decided by Saudi enforcement courts has increased by about 3% since the beginning of the year, compared to the same period last year, to reach 3,245 applications.
This comes at a time when the Ministry of Justice launched the unified electronic platform for dividing the estate to speed up the division process and facilitate the liquidation of estates with various assets, including investment portfolios, in partnership with the Capital Market Authority.
The estates that were decided by the enforcement courts varied between commercial and residential real estate, funds, and investment portfolios, as the Riyadh region courts accounted for the highest percentage, about 30.2% of the total disputes over which disputes occurred, by receiving 979 execution requests, according to statistics issued by the Ministry of Justice, which Al-Eqtisadiah reviewed.
The electronic services launched by the Ministry of Justice last October enable the beneficiary to submit a request to implement the division of an estate via the Najez platform and verify the heirs’ data through digital integration with the internal and external systems of both bodies, “Justice and the Financial Market.”
Returning to the highest regions in receiving and adjudicating cases, the Makkah Al-Mukarramah region came second with 654 execution requests, followed by the Al-Sharqiyah region with 554 requests, while the lowest region was Najran with 9 execution requests.
Ibrahim Al-Ali, the legal advisor, told Al-Eqtisadiah that the Ministry of Justice has digitized all procedures for dividing the estate among the heirs, in integration with the Saudi Central Bank, the Capital Market Authority, and the Assignment and Liquidation Center, which facilitates the experience of the beneficiaries and spares them the need to visit the implementation courts.
He pointed out that these new procedures contributed to finding solutions to the problems of troubled estates and expediting the decision on these claims.
In turn, the legal advisor, Muhammad Al-Mutlaq, explained that the new service for dividing the estate automatically retrieves the heirs’ data, determines the heir’s share of the bank accounts, issues the decision to divide the funds from the judicial department, and completes the process of dividing and disbursing the amounts automatically.
He pointed out that the issuance of the decision to liquidate the shares, completion of the liquidation process, disbursement of funds, etc., made these cases decided more quickly than before.
