Carpenter wrongfully dismissed: AK wins almost 44,000 euros in severance pay and termination compensation – 2024-06-26 17:23:23

Linz (OTS) Because he wanted to avoid paying severance pay, the boss of a carpentry business in the Linz-Land district invented a flimsy reason for dismissing the employee without notice. The fact that the entrepreneur did not get away with this trick was thanks to the efforts of the AK. It took the innocent carpenter to the labor and social court. There, the employee was granted all of his claims. He received back pay of almost 44,000 euros.

After 35 years with the company, a carpenter from the Linz-Land district received his notice of termination. On the one hand, this was painful, but on the other hand, he was entitled to severance pay and all termination claims. Shortly before the end of the notice period, the employer obviously became aware of this. And he was not above accusing the long-term employee of theft and dismissing him without notice. This would have meant that the carpenter would have lost all his claims.

He turned to the Chamber of Labor for help. Since he had not stolen anything and had not done anything wrong, the Chamber of Labor took action on his behalf. In an intervention to the company, the company pointed out that the dismissal was unlawful and made it clear that the employer still owes the former employee a number of payments: severance pay amounting to twelve months’ salary, outstanding wages, special payments not yet paid, vacation pay in lieu of unused vacation, and severance pay for the period between the unjustified dismissal and the notice period.

The letter did not lead to any insight from the company. In such cases, the AK contests legal recourse. It filed a complaint with the relevant labor and social court. The court investigated the allegations and examined evidence that the employer had submitted. Ultimately, the court came to the conclusion that the allegations were unfounded and that the dismissal was unjustified.

The carpenter was thus acquitted of the absurd charge of theft and was paid the unpaid labor law claims, a total of almost 44,000 euros.
