The Court of Justice of Sao Paulo (TJSP) has sentenced the accommodation booking platform Booking to pay moral damages to customers for canceling their reservations for the end-of-year holidays without informing them in advance.
The company will have to pay R$2,500 to each of the three consumers, who filed a lawsuit seeking compensation. The case occurred in a guesthouse in Ubatuba, on the north coast of Sao Paulo.

As reported in the trial, consumers arrived to check in at the inn, but minutes later their reservation was canceled and they were kicked out of the location without receiving any assistance from the platform responsible for the booking. The customers also claim they were physically assaulted and threatened by the restaurant owner.
The case had already been judged at first instance, when Booking was ordered to refund customers the amount paid for the accommodation, approximately R$ 2,000. The case has been ongoing in São Paulo’s judicial system since 2022, but was tried at second instance in November this year.
Judge Gomes Varjão, rapporteur of the appeal, decided that the company is responsible for what happened since it is part of the consumption chain and understands that the facts narrated by consumers “exceed those experienced in daily life and exceed what was reasonably expected in community life “. “.
