The defense of Jair Bolsonaro rejected on Wednesday before the Supreme Court that the former Brazilian president participated in a coup plot and reduced the prosecution’s accusation to mere “assumptions”, in a session that has left the trial ready for the sentence to be delivered.
“There is nothing, there is absolutely anything against Bolsonaro,” said Celso Vilardi, one of the ex -president’s lawyers, before the five judges of the First Chamber of the Supreme Court, who will resume the sessions next week, already in the definition phase.
The defense discounted Bolsonaro from the coup plot that, according to the accusation, sought to prevent the assumption of the current ruler, Luiz Inacio Lula da Silva, and keep the ultra -right -wing leader in power, despite his defeat in the 2022 elections.
Vilardi reduced the facts to “mere preparatory acts” that cannot be sorry, because at no time there was “violence or serious threat.”
Axes for a possible acquittal
Bolsonaro’s lawyers, who is in household prison and followed the audience from his home due to health problems, put together their argument on three axes. First, they requested the nullity of the exedecán of Bolsonaro’s judicial collaboration, Lieutenant Colonel Mauro Cid, which served as the basis for the investigation. Vilardi said that Cid “lied” and that his confession is vitiated, so it should be excluded from the process.
The lawyers also alluded to restrictions for the exercise of the defense and, finally, attacked the denunciation of the Attorney General, Paulo Gonet. They cross the conclusions of the prosecutor of “contradictory” and criticized that the complaint that imputes to Bolsonaro five crimes that could cost him up to 40 years in prison, is based on “narratives and assumptions”, according to Paul Cunha Bueno, another of the former president’s lawyers.
Thus, they requested the “imperative” acquittal of Bolsonaro, although Gonet’s thesis is radically opposite, since it places Bolsonaro in the center of the coup conspiracy and associates it with the assault on the institutions of January 8, 2023, a week after the investiture of Lula, when thousands of ultras To the new government.
According to the investigation, after his electoral defeat, Bolsonaro prepared a draft of presidential decree to establish exception measures, such as a state of siege, and even endorsed a plan to kill Lula, his vice president Geraldo Alckmin and Judge Alexandre de Moraes, now the coupling of the coup.
The process will resume on September 9, when Moraes will announce his opinion, which will be discussed with four other magistrates in the room in two other hearings planned for next week.
Possible amnesty
While the judicial process reaches its final stretch, Bolsonarism has strongly resumed its maneuvers in Congress in favor of an amnesty controversy for those involved in the January 2023 assonated.
The project is discussed since last year and, in principle, it would only favor those who participated directly in the excesses of January 8 of that year in Brasilia.
