Being a Victim of the Land Mafia, Cianjur Citizens Ask for AHY’s Help

JAKARTA – Ridwan, a resident of Cianjur, West Java, visited the office of the Minister of Agrarian Spatial Planning/Head of the National Land Agency (ATR/BPN) Agus Harimurti Yudhoyono (AHY). Ridwan complained about his fate as he was suspected of being a victim land mafia.

He still doesn’t own the rights to his land covering an area of ​​approximately 1.28 hectares. “We are submitting a complaint regarding neglect of obligations and/or violation of prohibitions in statutory provisions by the relevant agencies. Because it is suspected that there are indications that the land mafia is involved in influencing the handling and resolution,” said Ridwan’s attorney, Emanuel R Pandega, Saturday (22/6/2024 ).

“We ask for the attention of BPN, especially the Anti-Land Mafia Task Force, regarding our client’s legal problems which until now have not had a concrete solution,” he added.

Emanuel explained that this case started when a dispute occurred over ownership of the land where the shopping center will now be built. His client also took legal action up to the level of Judicial Review (PK), which Ridwan finally won. “It is final based on PK decision Number 160/Pdt/2007 dated September 28 2007,” he said.

However, while the PK effort was underway, he continued, there were a number of lawsuits with the same object and subject by opposing parties. Until finally the case was finalized with the PK’s decision. “PK Decision Number 245/Pdt/2011 dated February 20 2011 was defeated. So there were two conflicting legal products,” said Emanuel.

Meanwhile, Ridwan explained that his party had applied for a change of land ownership name to the local BPN after winning the PK. However, these efforts did not work as expected. “In 2012 we submitted a request to BPN to change the name, but there it kept being postponed, on the grounds that there were other cases,” he said.

Due to this, Ridwan suspects that there is a land mafia behind the land case. Therefore, he and his attorney complained to AHY.

“Because the PK has been executed, it should have been completed but it has been postponed waiting for the verdict, which I think is already a land mafia game. In the decision it is also alleged that it violates procedural law,” he said.

“Hopefully Minister AHY will pay attention to our complaint and that the legal rights of the dispute object that our client has won can be implemented,” continued Emanuel.

Ridwan hopes that in the future there will be criminal law for judges who misuse the Criminal Procedure Code (KUHAP), not just administrative sanctions. Because Ridwan suspects that procedural law has been violated in the judge’s decision which is detrimental to his party.
