Phase 2 of the Electronic Advertisement Verification System (EİDS) infrastructure regulations established by the Ministry of Commerce has come to an end. After the regulation, illegal businesses operating without authorization will not be able to post advertisements on the portals. Making evaluations on the subject, Mustafa Hakan Özelmacıklı, General Manager of Altın Emlak Global, said, “On 31 August 2023, the Regulation on Real Estate Trade was amended and the obligation to verify identity and authority was imposed on real or legal persons who provide electronic media for advertisements for the sale of real estate belonging to others, and the identity verification section of the said regulations was introduced.” It entered into force on November 1, 2023. Now, the authorization verification process, which is the 2nd Phase of this regulation, will be put into effect. Accordingly, the portals will confirm that the real estate subject to the announcement belongs to the member who made the announcement or, if this member is a real person, to his/her first and second degree blood relatives or spouse. “It will verify before publishing the announcement that the member who submitted it is authorized by the owner of the real estate subject to the announcement,” he said.
AUTHORITY VERIFICATION WILL BE DONE THROUGH E-GOVERNMENT INTEGRATION
Stating that the portals will verify real estate authorization through the Electronic Listing Verification System (EIDS) established within the Ministry of Commerce, Özelmacıklı said, “Integrations were made with the General Directorate of Land Registry and Cadastre for determining the owner of the real estate, and with the General Directorate of Population and Citizenship Affairs for determining kinship. E-Government.” On a new authorization screen that will be created in the system, the immovable properties belonging to the owner, if he is a real person, or to the legal entity of which he is the authorized representative, if he is a legal entity, will be listed. After selecting the real estate, the authorization period will be selected by entering the authorization certificate number of the authorized real estate enterprise or the contracted enterprise. “It will not be possible to publish the advertisement without checking the authorization. In this way, real estate businesses without an authorization certificate or those without kinship status will not be able to enter the advertisement,” he said.
