During the trip, when arriving at Le Dai Hanh Street, the 911 working group of Da Nang City Police was blocking this place and discovered Sinh was driving a motorbike but not wearing a helmet, so he ordered the vehicle to stop for inspection. .
Because he did not have a helmet and had consumed alcohol before, Sinh did not obey the order to stop the vehicle, but accelerated and crashed straight into the working group to escape, then ran back to the bar to continue drinking.
While drinking, because he was still angry about being stopped by the working group, Sinh told Cuong to “take him to work”. Before getting into the car driven by Cuong, Sinh picked up two rocks nearby and brought them along. When the two ran to the opposite side near the working group, Sinh told Cuong to slow down and threw 2 rocks at the working group, while cursing. After throwing, Cuong accelerated and took Sinh away through many roads, then returned to the above pub.
Because he was still angry, Sinh continued to invite Cuong to come back and throw rocks at the working group again, but Cuong agreed. Similar to last time, Cuong continued to drive the motorbike to carry Sinh, while Sinh picked up 2 rocks from under the tree next to the pub and threw them at the working group like the previous time.
After Sinh finished throwing, Cuong accelerated and ran away. At this time, the working group began to pursue. The two ran to the intersection of Nguyen Phuoc Tan and Cach Mang Thang 8, Cam Le district, and were caught up by the working group, so they had to abandon the car and run on foot until they were controlled and arrested. While running away, Cuong punched a police officer in the face, causing minor injuries, and while running away, Cuong and Sinh fell, causing skin abrasions…
Based on the documents and evidence collected, the Police Investigation Agency of Cam Le District Police determined that the actions of Sinh and Cuong had been discussed in advance, were closely linked and took place consecutively. continue without interruption. The above act has enough elements to constitute the crime of “Resisting people on public duty” according to the provisions of Clause 2 (with “organized” circumstances), Article 330 of the Penal Code.
