Army should do defense only, not business: Chief Justice of Pakistan

Chief Justice of the Supreme Court Qazi Faiz Isa on Wednesday said that the Pakistan Army should limit itself to defense-related tasks and avoid business activities.

A three-member bench headed by Chief Justice Qazi Faiz Isa heard various petitions related to illegal constructions in Karachi.

According to the cause list, these are six separate petitions, the first of which was filed in 2017 related to illegal construction and occupation of flats. Apart from this, the request regarding construction of illegal plaza on the land of the petitioner is also included.

During the hearing of the case against commercial activities on defense land in the Supreme Court today, Chief Justice Qazi Faiz Isa remarked that the army has started marriage halls and other works on the given land, assure that the army will only do defense work. Not business.’

Speaking to the Attorney General, Chief Justice Faiz Isa said, “Assure that if you don’t do business, then it’s okay, everyone should stay in their mandate, the army should do its job and the courts should do their job.”

The Attorney General replied that ‘the principle is that everyone should do their own work.’

On this, the Chief Justice said, ‘If you have such instructions, give assurance to the court.’

The lawyer of the Mutukah Waqf Property Board told the court that the building from which the dispute started belongs to the Mutukah Waqf Property Board.

Justice Muhammad Ali Mazhar said that ‘a five-storey building was being built, then the abandoned property board was watching?’

The Chief Justice also remarked that illegal construction is not possible without the connivance of the Sindh Building Control Authority (SCBA). The audit should also be done by FBR, the money from all the assets in excess of the income should be given to the residents of the demolished buildings, but the Sindh government will never do this inquiry.

The Chief Justice further said that ‘DG Sindh Building Control Authority is present in the court, tell me how many inspectors and officers are there in SCBA?’

DGSBCA replied that ‘There are a total of 1400 employees including 600 building inspectors and 300 senior inspectors.’

The court gave directions at the end of the hearing and said that ‘illegal constructions and residential buildings are being commercialized in Karachi, the builders leave with profits, the Sindh Building Control Authority turns a blind eye, after the building is completed, the SB CA reaches demolition,

Demolition after the completion of the building affects the rights of the residents, the building approval details should be displayed on the board during construction, the Sindh Building Control Authority cannot use the situation for its own benefit, the building is under construction. SBCA should not delay in issuing certificates.’

The Supreme Court adjourned the further hearing of the case indefinitely.
