The Court of Cassation rejected the appeal of 3 defendants who were convicted on charges of not operating a vessel identification device on board the ship, and not complying with the orders of public officials responsible for oversight and inspection, and ruled to uphold its previous ruling on the defendants by imprisoning the first defendant for a month and fining him 200 dinars and a 100 dinar bail to suspend the execution, and imprisonment. Both the second and third defendants were sentenced to two months in prison and deported from the country.

Details indicate that the Public Prosecution charged the appellants with a misdemeanor case by convicting the first defendant of not complying with operating the vessel identification device on board the ship, and convicting the second and third defendants of not complying with public employees regarding assistance to the inspection control of the boat and refraining from stopping for the Coast Guard patrol.

This was when the three defendants sailed on the boat belonging to the first defendant; They were stopped by a Coast Guard command patrol responsible for assisting, monitoring and inspecting boats, but during that time they fled by boat.

After the patrol was able to seize the boat and the defendants, it found that the first defendant, in his capacity as captain and owner of the ship, was not committed to operating the vessel identification device on board the boat when they were sailing.

Accordingly, the Public Prosecution demanded that they be punished in accordance with Law No. (32) of 2020 regarding the rules of registration, safety and control for small vessels, where the Minor Criminal Court ruled that the first accused be imprisoned for a month and fined him 200 dinars, and set a bail of 100 dinars to suspend the execution, and ruled that each of the second accused be imprisoned. The third is for a period of two months, with the implementation of the accusation against them and their final deportation from the country after the implementation of the sentence. The ruling stated that the incident was proven on evidence derived from what was proven in the confession of all the defendants before the court and in the investigations of the Public Prosecution.

The ruling was not accepted by the three defendants, which prompted them to appeal the ruling to the Court of Appeal, which ruled to reject it and uphold the appealed ruling. Accordingly, they appealed the ruling to the Court of Cassation, which ruled to reject it again.
