On Friday, Moroccan King Mohammed VI gave directions to the Supreme Scientific Council to study the issues contained in some of the proposals of the body charged with reviewing the Family Code (Personal Status Law).

The Moroccan Royal Court issued a statement in which it referred to instructions issued by King Mohammed VI, Chairman of the Supreme Scientific Council, to the aforementioned council, to “study the issues contained in some proposals of the body charged with reviewing the Family Code, based on the principles and provisions of the true Islamic religion and its tolerant objectives, and to submit a fatwa regarding them for His Majesty’s high consideration.”

This referral comes after the body tasked with reviewing the Code completed its tasks within the specified period and submitted its proposals to the King, who, given that some of the proposals were related to religious texts, required referring the matter to the Supreme Scientific Council, which Article 41 of the Constitution made the only body qualified to issue fatwas that are officially approved.

The Moroccan King called on the Supreme Scientific Council, while issuing fatwas regarding the proposals presented to it, to recall the contents of the royal message addressed to the Prime Minister, calling for the adoption of the virtues of moderation and open, constructive diligence, in light of the rule that the king has always expressed, of not allowing forbidden analysis or prohibition. Last September, King Mohammed VI directed the government to reconsider the Family Code, after years of demands from women’s associations to introduce reforms to it.

King’s directives to reform the family code

The Moroccan King gave a set of directives, in order to reform the Family Code, and outlined the work methodology that must be adhered to, including, according to what was stated in a previous statement by the Royal Court:

• The need to adapt the Family Code to the development of Moroccan society and the needs of sustainable development.

• Commitment to the objectives of Islamic law and the specificities of Moroccan society in developing the Family Code.

• Relying on the virtues of moderation, open-mindedness, consultation and dialogue in this context.

• Emphasizing that the desired improvement must focus on correcting imbalances and amending requirements that have become inappropriate due to the development of society and laws.

• Preserving basic references and principles such as justice, equality, solidarity and harmony derived from Islam and international agreements.

• The necessity of using constructive diligence to ensure compatibility between the Islamic authority and international legal developments.
