Jordan began its war on brokers active in the field of illegal immigration, as the Irbid Governorate Public Prosecutor decided to arrest a person for 15 days in the Correction and Rehabilitation Center on charges of human trafficking after he worked as a broker to facilitate the travel of people to foreign countries in ways that violate the law and endanger the lives of victims, which has become Known as illegal immigration issues.
The Public Prosecution also decided to prevent another person, who works as the owner of a tourist services office, from traveling for a period of three months, extendable for a year, pending the case under Article 15/A/3 of the Human Trafficking Prevention Law.
The crime of human trafficking
According to the law, illegal immigration is considered a human trafficking crime, and its commission carries two aggravating circumstances: the first is that it is a crime of a transnational nature, and the second is that there are multiple perpetrators and victims, and its penalty reaches imprisonment for up to 20 years and a fine of up to 20,000 dinars.
Two people who were victims of illegal immigration filed a complaint with the competent security authorities, and the Human Trafficking Unit investigated it. It was revealed that there was a suspicion that the crime of human trafficking had been committed jointly within the limits of Articles 9/C/8 and 9/C/2, which is a crime of a transnational nature in which there are multiple perpetrators and victims. On them, and in light of Article 3 of the Human Trafficking Prevention Law No. 9 of 2009, as amended, and Article 76 of the Penal Code.
The dimensions of the case indicate that the security conditions to which victims of illegal immigration are exposed are very dangerous, according to what was published by the Jordan News Agency, and that the people, brokers and merchants who are dealt with are unknown and only names are known about them such as Abu Hala Al-Yamani and others, and therefore it is difficult to know and pursue them, in addition to The high sums of money that are seized in this type of migration, endangering their lives, violating the laws of countries and the sanctity of borders, tearing up every person’s passports and identification papers, claiming that they are from countries of war, killing and displacement, and not recognizing their original places of residence, and these issues have turned into Stimulating public opinion, misleading the youth, beautifying the paths of death and throwing oneself into destruction and the unknown.
Article 12/c of the Human Trafficking Prevention Law indicates that the competent authorities shall ensure, wherever possible, the protection of the victim and his psychological, physical and moral safety and shall work to create appropriate conditions to assist him and care for him healthily, psychologically, educationally and socially, and to rehabilitate and integrate him in a way that respects his humanity and preserves his humanity, and facilitates his return to his homeland in a manner Safe, fast, and with the child’s best interest in mind.
The law confirms that, despite what is stated in any other legislation, the Public Prosecutor may decide to stop prosecuting any of the victims and those affected by human trafficking crimes if it is proven that he has committed any of the human trafficking crimes stipulated in this law, participated in them, interfered in them, or incited them. If he commits a misdemeanor related to the crime of human trafficking, participates in it, intervenes in it, or incites it, any interested party may appeal the Public Prosecutor’s decision to the competent judicial authority.
The Public Prosecution called on every person who has fallen victim to brokers of illegal immigration and human trafficking to file a complaint with the competent security authorities, as reaching the perpetrators of the greatest crime and protecting the individual and society is the primary goal of its work.
