The Court of Cassation ruled to reject the appeal of a director of a carpentry company who was sentenced to 3 months in prison and a bail of 100 dinars to suspend the implementation of the sentence after he accidentally caused the death of a worker in the company.

Details of the incident indicate that the Public Prosecution has charged the appellant in a misdemeanor case, as he accidentally caused the death of one of the workers as a result of his violation of what the profession’s principles impose on him by committing the violation that caused the worker’s death, as the accused, who is the director of the machinery and wood department, did not commit to taking due care. A sufficient number of workers were trained to use fire-fighting means to ensure appropriate behavior in the event of an outbreak, and he did not commit to educating workers about the dangers of fire in a way to prevent and combat it, as due to the outbreak of a fire in one of the machines in the company and the work team’s attempt to extinguish it, the victim worker suffered separate burns on his body. As a result, he was taken to the hospital, but the victim died of his wounds.

The defendant’s lawyer indicated in his defense that his client, the appellant, was convicted of murder and accidentally causing the victim’s death due to one of the company’s machines, but the machine that caused the victim’s death was supplied to the company in accordance with the specifications and standards included in the spark extinguishing system, and thus the company that was appointed Supplying the machine is responsible for connecting this system and operating it in accordance with the contract concluded with it, but the supplying company did not connect it and thus violated its contractual obligation, especially since the warranty period for it expired before the incident without any malfunctions occurring, which negates the element of fault from its client and breaks the causal link between the error and the damage that occurred. The High Criminal Court had ruled that the director be punished with imprisonment for a period of 3 months and a bail of 100 dinars, but he was not satisfied with the sentence issued against him. He appealed the ruling to the Court of Appeal, where his appeal was rejected.
