The High Civil Court ruled to evict a tenant from a rest house and oblige him to pay the plaintiff an amount of 3,469 dinars.
The facts, according to lawyer Ahmed Al-Dosari, are that the defendant rented a rest house from the plaintiff in exchange for a monthly rent of 250 dinars, but the defendant failed to pay the monthly rent due from September 2023 until November 2023, and accordingly his debt became occupied in the amount of 3,469 dinars, claiming That the plaintiff had promised him to provide a guard and electricity in the “rest house,” and he provided them during the first period and then withdrew them, requesting that the case be referred for investigation to prove that the plaintiff did not respond to the defendant’s request to provide the original contract as well as the agreement to provide a guard and electricity.
For its part, the court explained in the course of its ruling to reject the defendant’s request regarding referring the case for investigation because this request is not productive in the case, as what is established from the lease contract is that the two parties have agreed that the defendant will bear the electricity expenses and that his lack of knowledge of the requirements required by the authorities The official application does not prejudice the claimant’s right to request the rent.
The court pointed out that the statement of claim notified to the defendant is considered a written notice that has the effect of being a preliminary procedure for ruling on expulsion, and that the defendant attended and decided that he had no objection to vacating the “residence.”
Accordingly, the court ruled to expel the defendant from the rest house, oblige the defendant “tenant” to pay the plaintiff an amount of 3,469 dinars with legal interest at the rate of 1% annually from the due date until full payment, and obligate him to pay other expenses in exchange for attorney’s fees.
