A disposal fee will be paid for passenger cars brought to the customs territory of Azerbaijan and 4 years after the date of production.
Publika.az reports that the related issue was reflected in the draft law on the amendment to the law “On production and household waste”, which was discussed in the agenda of the extraordinary session of the Milli Majlis held on June 6.
According to the document, article 14 of the law states in the general provisions on the disposal of vehicles:
The disposal fee is paid to the vehicle disposal fund during the customs clearance of passenger cars brought to the customs territory of the Republic of Azerbaijan and 4 (four) years after the date of production (except for rare passenger cars and passenger cars temporarily brought to the customs territory), as well as during the state technical inspection of vehicles. .
Payment of the disposal fee by the declarants for bringing passenger cars to the customs territory is ensured by the customs authorities.
The disposal fee for the state technical inspection is paid when the vehicle is actually submitted to the technical inspection within the time limits stipulated in Part VI of Article 30 of the Law of the Republic of Azerbaijan “On Traffic”.
The amount of the disposal fee is determined by the body (institution) determined by the relevant executive authority according to the year of production of the vehicle.
The activity of disposal of vehicles can be carried out by persons registered in the register provided for in Articles 14-4 and 14-5 of this Law (hereinafter – utilizators) and other persons.
Taking into account the requirements of articles 14-7 and 14-8 of this Law regarding vehicles given to disposal, a confirmation document is issued by the utilizers, which reflects the amount of the discount and the amount of one-time payment.
Acceptance of vehicles for disposal by the disposers is carried out on a rotating basis and free of charge.
Discounts are applied by vehicle dealers when new locally produced vehicles are purchased with the delivery of a valid document. The amount of the concession is determined by the body (institution) determined by the relevant executive authority.
It should be noted that the means of transport means the means of transport provided for in parts II and III of Article 27 of the Law of the Republic of Azerbaijan “On Traffic”. The provisions of this chapter do not apply to other vehicles and they are accepted for disposal on the basis of a contract concluded in accordance with civil legislation.
For the purposes of this chapter, sellers of vehicles are natural or legal persons who are registered as taxpayers in accordance with the Tax Code of the Republic of Azerbaijan and carry out entrepreneurial activities for the sale of vehicles.
According to the draft law, a vehicle disposal operator cannot engage in vehicle disposal activities. The operator only supervises the management of funds of the disposal fund of vehicles, keeping and maintaining the register of utilisers. Also, summarizing the information submitted to him, he submits written information to the body (institution) determined by the relevant executive authority by February 20 of each following calendar year.
The first-fourth parts of Article 14-1 and Article 14-3 of this Law shall enter into force from February 1, 2024, and other provisions of Chapters II-I from September 1, 2024.
