The Netherlands should not have revoked temporary protection for third-country nationals from Ukraine from September 2023, the Council of State said on Wednesday. This does not mean that the group of third-country nationals can still stay. Their protection expires on March 4, 2024.

Ukrainian third-country citizens are people who have stayed in Ukraine on a temporary residence permit. This concerns, for example, students, migrant workers or people who have applied for asylum. They also fled when Russia invaded Ukraine in 2022.

Initially, like other Ukrainian refugees, they were welcomed in the Netherlands under the so-called Temporary Protection Directive. But the outgoing government decided last year to block this directive for the group of third-country nationals. As a result, third-country nationals would have to either seek asylum or leave.

Several third-country nationals therefore decided to appeal to the court. They disagreed that their temporary protection was still revoked. “The fact that our home countries are safe does not mean we can return,” one of them told NU.nl at the time.

The judge has now put an end to the outgoing cabinet’s decision. The outgoing cabinet had previously announced that it would need a week to assess the exact consequences of the ruling.
