#Benin: The Government’s justifications for new regulations in the funeral sector

This Wednesday, June 19, 2024, the Beninese Government issued a new decree in the Council of Ministers to regulate the funeral sector.
The current regulatory text is 30 years old. This is the interministerial decree of February 23, 1995 regulating the activities of funeral directors by private companies.

According to the findings of the Beninese Executive, this text, which has become obsolete, does not take into account all aspects of the funeral sphere and is limited to the management of private funeral companies.

In the justification for the adoption of a new Decree, the Council of Ministers points out that the old one does not address the management of cemeteries, while in recent years, conflict situations have been recorded, originating from their development and in places there are serious shortcomings, particularly with regard to respect for the physical integrity and memory of the deceased. All things to which are added shortcomings in matters of environmental protection.

It is therefore because of all these inadequacies that the Government considered that it is urgent to strengthen regulations in order to reorganize the funeral sector by bringing it up to the norms and standards required in terms of health, hygiene, sanitation and environment in force in Benin.

The new Decree adopted during the weekly meeting of Ministers this Wednesday, “thus establishes innovations which apply to the categorization of these activities, the setting of technical, health and environmental standards applicable to the creation and management of funeral homes, funeral homes, crematoriums and cemeteries.

It also provides for the minimum qualifications required to operate in this field and the sanctions incurred by violators of the rules laid down.
