About two years ago, Prashant Kumar Halder alias PK Halder and his five associates were arrested in Kolkata for embezzling and smuggling tens of thousands of crores of rupees from Bangladesh. But the lawyer of the accused Milan Mukherjee raised a question as to why he is being kept in jail day after day without trial in the local court in the discussed case.
Alleging that this is being done systematically, this senior lawyer from Kolkata said that it is somehow being delayed so that the accused can be kept in jail for a long time.
Referring to a judgment of the Supreme Court of the country, he said, “There is a judgment of the Supreme Court that one cannot be kept in jail for a long time without a trial.” Today I informed the honorable court about this law. I will finish the bail application in the next hearing.

On Thursday (March 21), his lawyer Milan Mukherjee made this comment while applying for the bail of PK Halder’s brother Pranesh Kumar Halder in the city sessions court of Kolkata.
The main accused in the case, PK Halder, has already been sentenced in the court of Bangladesh. But his judgment has not yet been completed and until the copy of the judgment reaches the Kolkata court, there is a hurdle in proceeding with the trial in India, Milan Mukherjee said.
He said that the judgment of this verdict has not been given in Bangladesh yet. Only the suggested order is placed. That’s why I can’t challenge and appeal in the higher court. I think it is being delayed somehow, so that the accused can be kept behind bars.

On this day, the money laundering case against PK Halder was heard in the City Sessions Court (Bankshal) of Kolkata, but it was postponed again. The case was heard in the court’s special CBI Court-1 Judge Prasanna Mukherjee’s bench.
On this day, Milan Mukherjee only asked for the bail application of Pranesh. In that case, he made a strong plea for bail. There was no opposition to the bail by the Enforcement Directorate (ED), the agency investigating the case. The next hearing of the case will be held on April 4.

On the other hand, ED’s lawyer Arijit Chakraborty said that hearing of Pranesh Kumar Halder’s bail application is going on. Senior lawyer Milan Mukherjee told the court on his behalf. Then we will respond. Then His Highness will judge and decide.
Six accused, including accused PK Halder, his brother Pranesh Halder, Swapan Mistry alias Swapan Maitra, Uttam Mistry alias Uttam Maitra, Imam Hossain alias Eamon Halder and Amana Sultana alias Sharmi Halder, were produced in the court on Thursday after several rounds of judicial custody.
It is noted that on May 14, 2022, India’s investigative agency ED arrested PK Halder from Vedic Village in Rajarhat, West Bengal. Also, five more of his accomplices were arrested in various parts of the state. Charges have already been framed in court against the accused.
Currently, five male accused including PK Halder are in Kolkata’s Presidency Jail. The only female accused has been lodged in the Alipore Women’s Correctional Facility.
