At the time of the crime W. was a soldier, so the case was handled by the special military chamber in Arnhem.
Accident and accident under the influence
An 83 year old cyclist was fatally hit by W. with his car. The victim was thrown by the impact and fell to the ground tens of meters from the accident site. W. was under the influence of drugs and alcohol at the time. After the accident he continued driving and a few hundred meters further on he crashed into a tree. W. subsequently declared that he wanted to end his life.
Eight days before the fatal accident, he had attacked his girlfriend at her home. The court found that serious assault had not been proven.
W. suffers from post-traumatic stress disorder, ADHD and multiple addictions, research has shown. The accident and continued driving are therefore attributed to him to a lesser extent. The sentence is lower than that requested by the Prosecutor’s Office (3.5 years of which 1 year suspended). He will also lose his driving license for 4 years.
