The villa owner said he was very happy to be able to maintain the current land use status and implement the decision of the Ca Mau City government (Ca Mau province) on the prescribed procedures.
“Last time I was very sad, I couldn’t do anything, I was always worried about the house. Now that Ca Mau City allows me to keep the land in its original state and keep the house, I’m very happy,” said Mr. Ho An T., owner. , told reporters Dan tri on the afternoon of February 6.
According to Mr. T., the recent decision to amend and supplement the Ca Mau City People’s Committee on sanctioning administrative violations against him has two contents.
The government, in addition to forcing Mr. T. to maintain the current land use status as at the time of discovering the violation (ie when the villa was built) and change the use purpose of more than 2,261 square meters of land, also forced him to restore the land. Restore the original state of more than 1,303 square meters.
“Whatever the People’s Committee of Ca Mau City decides, I will do so,” Mr. T. said and said that he has completed the procedures to change the land use purpose of the area allowed to be transferred.
According to Mr. T., the land returned to its original state is located behind the villa, which currently has a tomb, fish pond, tree planting,…
“The tomb area is also solid. I did it before building the villa so I don’t know what to do,” Mr. T. said.
According to the People’s Committee of Ca Mau City, Mr. Ho An T. was granted a certificate for aquaculture land of more than 3,500 square meters in Tan Thanh commune. Of which, the construction area is more than 864m2 (the main house is about 294m2, there are also outbuildings, tombs, small landscapes…).
“At the time of building houses and structures (before December 2022) on land while not changing the use purpose from aquaculture land to residential land, it is not in accordance with the provisions of land law,” City People’s Committee said. Ca Mau clearly defined.
On January 9, 2023, the People’s Committee of Ca Mau City decided to fine Mr. T. a fine of 22.5 million VND and forced him to restore the original condition of the land before the violation.
On November 15, 2023, Ca Mau City People’s Committee decided to amend and supplement part of the above penalty decision.
Specifically, the city government forced Mr. T. to maintain the current land use status as at the time the violation was discovered (ie when the villa was built). Villa owners must carry out land procedures (change of use purpose) according to regulations for an area of more than 2,261 square meters.
“The decision to amend and supplement part of the decision on sanctioning administrative violations dated January 9, 2023 is in accordance with legal regulations,” Ca Mau City People’s Committee affirmed.
